Section 29
Review Committee
: (1) There will be a review committee as follows to review the communication record work:
(a) Secretary, Ministry of Home Affairs – Chairman
(b) Joint Secretary, Ministry of Law, Justice and Parliamentary Affairs – Member
(c) Joint Secretary, Ministry of Information and Communication – Member
(2) The officer who gives an order according to Section 19 to disable telephone, mobile phone or any other means of communication or arranges that there is no contact with the telephone or means of communication, or gives permission according to Section 25 to record communication or gives an order according to Section 26, along with the documents related to such permission or order The details should be submitted to the review committee on the day the order is given, if possible, or later.
(3) The review committee as per sub-section (1) shall review the permission or order so granted within three days of receiving the details as per sub-section (2).
(4) When reviewing according to sub-section (3), if such permission or order is not found necessary for the investigation of organized crime, the review committee according to sub-section (1) shall cancel such permission or order.
(5) If the review committee as per sub-section (1) revokes the communication record permission or order as per sub-section (4), to immediately stop the work related to the communication record and to destroy the recorded communication on the same day as specified or to destroy the telephone, mobile phone or any other means of communication or For arranging that there is no phone or communication contact, the authority giving such permission or order will be ordered to activate such phone, mobile phone or other means of communication.
(6) The review committee under sub-section (1) shall regularly submit the details of its work to the Government of Nepal.
